The Reality of the Istihsan According to Al Hanafia School

Abstract

      Al Hanafia School used the Istihsan principle until they became famous for it, where Abu Hanifa was incomparable with it. Istihsan in all its forms is nothing but an alteration of a general rule, texts, an analogy, or an extracted origin for legal evidence that requires modification. This act of Istihsan was not an opinion, preference, self-distance, or derogation of legal evidence, rather the Istihsan was based on evidence that may be a hidden analogy, text, consensus, necessity, custom, interest, or a general jurisprudential rule.
