From particular problems of understanding extremism and terrorism to the conceptual problems of criminal policy formation. First part

Abstract

В статье исследованы понятия экстремизма и терроризма в широком философском и в узкоправовом контексте, в результате чего представлена картина сложности феноменов экстремизма и терроризма на концептуальном уровне, проведён междисциплинарный анализ, рассмотрено, как эти понятия работают в разных сферах и какой может быть результат неточного, неполного, неадекватного или чрезмерно узкого понимания этих явлений. С помощью метода перехода от частного к общему использованы два частных понятия и явления (экстремизм и терроризм) и с их помощью рассмотрен один из возможных путей перехода к более общей проблеме – формированию уголовной политики. Феномены экстремизма и терроризма использованы также как отправная точка для перехода в концептуальность. Сравнение частных и общих проблем и явлений позволило увидеть концептуальные проблемы уголовной политики и обозначить научные задачи, решение которых необходимо для её формирования. The article explores the concepts of extremism and terrorism in a broad philosophical and narrow legal context, as a result of which a picture of the complexity of the phenomena of extremism and terrorism is presented at the conceptual level, an interdisciplinary analysis is carried out, how these concepts work in different areas and what the result of inaccurate, incomplete, inadequate or overly narrow understanding of these phenomena. With the help of the method of transition from the particular to the general, two particular concepts and phenomena (extremism and terrorism) are used, and with their help, one of the possible ways of moving to a more general problem – the formation of criminal policy is considered. The phenomena of extremism and terrorism are also used as a starting point for the transition to conceptuality. Comparison of particular and general problems and phenomena made it possible to see the conceptual problems of criminal policy and identify the scientific tasks that need to be solved for its formation.
