Abstract

إن الاستثناء عقب الجمل المتعاطفة من الموضوعات الجليلة في علم أصول الفقه، والتي يحتاج إليها الفقيه، والأصولي، وکل دارس لهذا العلم، لا سيما أن الاستثناء من أهم الأدلة المخصصة للفظ العام، ويهدف البحث إلى بيان حکم الاستثناء عقب الجمل المتعاطفة، مع ذکر بعض الأمثلة التطبيقية المخرجة على هذا، وقد تکون  البحث من مقدمة، وتمهيد، وثلاثة مطالب، وخاتمة، أما المقدمة: فقد اشتملت على أهمية الموضوع، وأسباب اختياره، والدراسات السابقة فيه، ومنهجي في البحث، وخطة البحث، وأما التمهيد: ففي تعريف العام والخاص، والتخصيص، وأنواع المخصصات إجمالا، وأما المطلب الاول: ففي تعريف الاستثناء، وأنواعه، وأرکانه، وأدواته، وشروط صحته، وأما المطلب الثاني: فتناول تحرير محل النزاع في المسألة، وأقوال العلماء فيها، وأدلتهم، ومناقشة الأدلة، وبيان الراجح، وأما المطلب الثالث: فتناول بعض الأمثلة التطبيقية المخرجة على أصل الاستثناء عقب الجمل المتعاطفة، وبيان ربطها به، وأما الخاتمة فقد اشتملت على أهم نتائج البحث. Istithna’ (exception) following conjoined sentences is a key topic in the field of Usul ul-Fiqh (Principles of Jurisprudence), which fall within the scope of interest for jurists, scholars of Usul ul-Fiqh, and every learner specialized in this field. Exception in Arabic syntax delimits general statements, and hence the present study aims to explain the rule of exception following conjoined sentences, sustaining it with some examples. Accordingly, the study consists of a preface, an introduction, three chapters, and a conclusion. As for the preface, it introduces the significance of the topic, the reasons for selecting it, and previous respective studies, in addition to my methodology in the research, the research plan, and an introduction: in the definition of the general and the specific, and the specification, and the types of allocations in general; as for the first requirement: in the definition of the exception, its types, elements, tools, and conditions for its validity; and as for the second requirement: it deals with editing the subject of the dispute in the issue, and the sayings of scholars therein, and their evidence, a discussion of the evidence, and the statement of the most correct; and the third requirement: it deals with some applied examples produced on the origin of the exception following sympathetic sentences, and an explanation of their connection to it. As for the conclusion, it includes the most important results of the research.
