Prosesi wakaf ketika dilakukannya ikrar dari wakif untuk melepas hak milik pribadinya menjadi hak milik umum. Oleh karena itu, sejatinya bahwa hak milik yang sudah diwakafkan telah menjadi lepas kepemilikannya dari wakif dan berubah menjadi milik penerima wakaf melalui nadzir wakaf. Penelitian ini bertujuan untuk mendeskripsikan dan menganalisis terkait penarikan wakaf yang dilakukan oleh ahli waris di desa Sigalapang Julu setelah wakif meninggal dunia. Adapaun jenis penelitian ini adalah studi lapangan dengan sifat deskriptif. Pendekatan dilakukan dengan menggunakan hukum normatif. Pengumpulan data melalui observasi, wawancara, dokumentasi dan studi pustaka. Temuan data-data dianalisis dengan menunggunakan dalil nas dan pendapat ulama. Hasil penelitian menjelaskan bahwa praktik penarikan wakaf yang dilakukan oleh ahli waris di desa Sigalapang Julu pasca meninggalnya wakif bertolak belakang dengan aturan dalam ajaran Islam, sebab harta yang sudah diwakafkan secara otomatis menjadi milik umat Islam. \nKata Kunci: Wakaf, Wakif, Nadzir, Tabarru’. \nAbstrac \nWaqf is part of the tabbarru 'charity which is recommended in Islamic teachings. The waqf procession is when a pledge is made from the wakif to release his private property rights into public property. Therefore, it is true that the property rights that have been waqf have become free of ownership from the wakif and turned into the property of the waqf recipient through the waqf nadzir. This study aims to describe and analyze related to waqf withdrawals carried out by heirs in Sigalapang Julu village after the wakif died. The type of this research is a field study with a descriptive nature. The approach is carried out using normative law. Collecting data through observation, interviews, documentation and literature study. The findings of the data were analyzed by waiting for the arguments of the texts and the opinions of scholars. Abstract
Wakaf merupakan bagian dari amal tabbarru’ yang dianjurkan dalam ajaran Islam. Prosesi wakaf ketika dilakukannya ikrar dari wakif untuk melepas hak milik pribadinya menjadi hak milik umum. Oleh karena itu, sejatinya bahwa hak milik yang sudah diwakafkan telah menjadi lepas kepemilikannya dari wakif dan berubah menjadi milik penerima wakaf melalui nadzir wakaf. Penelitian ini bertujuan untuk mendeskripsikan dan menganalisis terkait penarikan wakaf yang dilakukan oleh ahli waris di desa Sigalapang Julu setelah wakif meninggal dunia.
