Historically determined transformation of the understanding of the proof process

Abstract

В статье проанализированы основные этапы развития процесса доказывания в уголовном судопроизводстве в истории России. Показано, как смена формы уголовного судопроизводства (разыскное, обвинительное, инквизиционное, смешанное) влияла на основные взгляды на процесс доказывания, виды доказательств, способы и источники их собирания и т. д. Автор отмечает необходимость при оценке доказательств сочетать мыслительную деятельность с практической составляющей. В работе отражены мнения российских учёных, приведены собственные выводы автора об исторических процессах трансформации понимания процесса доказывания в Российской Федерации, а также их причины. The article analyzes the main stages in the development of the process of proof in criminal proceedings in the history of Russia. It is shown how the change in the form of criminal proceedings (detective, accusatory, inquisitorial, mixed) influenced the main views on the process of proof, types of evidence, methods and sources of their collection, etc. The author notes the need to combine mental activity with a practical component when assessing evidence. The paper reflects the opinions of Russian scientists, presents the author's own conclusions about the historical processes of transformation of the understanding of the process of proof in the Russian Federation, as well as their reasons.
