Departmental organizational control over the criminal procedural activities of investigative bodies

Abstract

Исследование вопросов организации ведомственного контроля в Следственном комитете Российской Федерации показало наличие определенных проблем, в том числе в определении и упорядочивании его видов. Так, одним из них является организационный контроль. Он является предметом спора среди профильного научного сообщества относительно природы и понятия, а также содержания его элементов, что на практике порождает отсутствие единообразного подхода к реализации. Целью настоящего исследования является определение природы и понятия ведомственного организационного контроля и его элементов применительно к уголовно-процессуальной деятельности следственных органов. При этом предполагается разграничить ведомственный организационный и процессуальный контроль за уголовно-процессуальной деятельностью следственных органов. В ходе проведения настоящего исследования для отбора и анализа эмпирического материала использовались следующие методы: догматический (изучение и анализ законодательства и межведомственных нормативных правовых актов, соглашений, организационно-распорядительных документов в сфере реализации организационного контроля); исследование практики реализации организационного контроля (изучение и анализ материалов по реализации организационного контроля в следственных органах России); наблюдение (за работой следственных органов России в сфере реализации организационного контроля); включенное наблюдение (личный опыт автора как следователя и сотрудника подразделения процессуального контроля в системе следственных органов Следственного комитета Российской Федерации). Основным результатом исследования стало определение природы и понятия ведомственного организационного контроля и его элементов применительно к уголовно-процессуальной деятельности следственных органов, отграничение его от процессуального контроля. The study of the organization of departmental control in the Investigative Committee of the Russian Federation showed the presence of certain problems, including in the definition and ordering of its types. So, one of them is organizational control. It is the subject of dispute among the relevant scientific community regarding the nature and concept, as well as the content of its elements, which in practice gives rise to the lack of a uniform approach to implementation. The purpose of this study is to determine the nature and concept of departmental organizational control and its elements in relation to the criminal procedural activities of investigative bodies. At the same time, it is supposed to distinguish between departmental organizational and procedural controls over the criminal procedural activities of investigative bodies. In the course of this study, the following methods were used for the selection and analysis of empirical material: dogmatic (study and analysis of legislation and interdepartmental regulatory legal acts, agreements, organizational and administrative documents in the field of organizational control implementation); study of the practice of organizational control implementation (study and analysis of materials on the implementation of organizational control in investigative bodies of Russia); observation (over the work of investigative bodies of Russia in the implementation of organizational control); participant observation (personal experience of the author as an investigator and an employee of the procedural control unit in the system of investigative bodies of the Investigative Committee of the Russian Federation). The main result of the study was the definition of the nature and concept of departmental organizational control and its elements in relation to the criminal procedural activities of investigative bodies, its separation from procedural control.
