Under the new code of criminal procedure of Ukraine, there are four types of judicial review: appeal proceedings; cassation proceedings; proceedings on newly discovered circumstances; proceedings in the Supreme Court of Ukraine. Abstract

一般公认的国际和欧洲法律标准之一是,任何被定罪的人都有可能向最高法院提出申诉,要求审查判决。这一标准已载入国内立法。《乌克兰宪法》第125条第4部分规定,根据乌克兰的法律,有地方法院和上诉法院,对法院判决提出上诉和撤销上诉的规定涉及刑事司法的基本原则(《乌克兰宪法》第129条第3部分第8款),通过确保刑事诉讼的任务得到执行,高级法院对第一审法院作出的判决和裁定的合法性和效力进行核实。根据乌克兰新的刑事诉讼法,司法审查有四种类型:上诉程序;废弃程序;对新发现情况的诉讼;乌克兰最高法院的诉讼。这四种司法审查都是刑事诉讼程序的组成部分,每一种都是一个独立的阶段。
