Abstract

The given article is dedicated to the main problem of assessment regarding the admissibility of evidence obtained as a result of an unlawful arrest. The essence of the connection between the causality related to such pieces of evidence and arresting facts was studied in the given article. The issues on the admissibility of the evidence have been discussed, obtained not only as a result of a non-lawful arrest but also by violation within the process of arrest. Foreign experience regarding the admissibility of such kind of evidence is presented.
