On the issue of forgery of documents in the field of medical care of the population (based on the materials of the Republic of Kazakhstan)

Abstract

В статье рассматриваются вопросы современного состояния и перспектив расследования преступлений, связанных с подделкой документов в сфере медицинского обслуживания населения. Актуальность данного вопроса обусловлена рядом объективных факторов: ростом количества и опасностью такого вида преступлений в условиях пандемии, когда вред от данных преступлений приобретает особое значение, выражающееся в угрозе причинения вреда жизни и здоровью людей; возрастающим количеством видов и форм медицинской документации и, как следствие, риском, связанным с уголовной квалификацией ее неправильного оформления. В статье авторами на основании проведенного анализа нормативных правовых актов отражено, что документы в сфере медицинского обслуживания населения в Республике Казахстан подразделяются на документы в области здравоохранения и санитарно-эпидемиологического благополучия населения. Проводится анализ правоприменительной практики и статистических сведений, приводятся примеры судебно-следственной практики. По результатам исследования с учетом особой обстановки совершения рассматриваемой категории преступлений в сфере здравоохранения констатируется необходимость выделения отдельной уголовно-правовой нормы о подделке документов в сфере медицинского обслуживания населения, разработки криминалистической характеристики таких преступлений. The article discusses the issues of the current state and prospects of investigating crimes related to forgery of documents in the field of public health care. The relevance of this issue is due to a number of objective factors: an increase in the number and danger of this type of crime in a pandemic, when the harm from these crimes is of particular importance, expressed in the threat of harm to human life and health; an increasing number of types and forms of medical documentation and, as a consequence, the risk associated with the criminal qualification of its incorrect registration. In the article, the authors, based on the analysis of regulatory legal acts, reflect that documents in the field of medical care of the population in the Republic of Kazakhstan are divided into documents in the field of healthcare, and sanitary and epidemiological welfare of the population. The analysis of law enforcement practice and statistical data is carried out; examples of judicial and investigative practice are given. According to the results of the study, taking into account the special situation of the commission of the considered category of crimes in the field of healthcare, it is stated that it is necessary to allocate a separate criminal law norm on the forgery of documents in the field of medical care of the population, to develop a criminalistics description of such crimes.
