مکانة وأهمیة الآداب الإسلامیة فی التشریع الإسلامی

Abstract

هدفت هذه الدراسة إلى معرفة مکانة الآداب الإسلامية في التشريع الإسلامي ، ومدى أهميتها من خلال استقراء علاقتها بمقاصد الشريعة الإسلامية ، والأبعاد التي تنطوي عليها هذه الآداب وما لها من أثر في خدمة وتحقيق مقاصد الشريعة الإسلامية . وقد توصلت الدراسة إلى مجموعة من النتائج ، منها : أن الآداب الإسلامية ذات صبغة أخلاقية، وحضارية، وإنسانية راقية ، وهي معلم من معالم خيرية هذه الأمة ، وجزء أصيل من هوية المسلم التي باتت في عصرنا قاب قوسين أو أدني من الذهاب والذوبان ، کما أنها مظهر من مظاهر تفرد المسلمين وتوحدهم في أسلوب حياتهم، وممارسة مختلف نشاطاتهم، وعاداتهم . ومنها : أن الآداب الإسلامية لها أبعاد اجتماعية واقتصادية وتربوية وتعليمية تساهم بشکل فعال في خدمة مقاصد الشريعة الإسلامية مما يجعل الآداب الإسلامية تتبوأ مکانة وأهمية بارزة في التشريع الإسلامي . This study aimed to know the status of Islamic ethics in Islamic legislation, the extent of its importance by extrapolating its relationship to the purposes of Islamic law, the dimensions involved in these ethics and its impact on serving and achieving the purposes of Islamic law. The study reached a set of results, including: that Islamic literature is of an ethical, civilized, and human nnature, and it is a milestone of the charitable causes of this nation, And an inherent part of the identity of a Muslim who has become around the corner of our time going and thawing, and it is also a manifestation of the uniqueness of Muslims, uniting them in their way of life, and practicing their various activities and customs. Including: that Islamic literature has social, economic, educational and educational dimensions that contribute effectively to serving the purposes of Islamic law, which makes Islamic literature occupy a prominent position and importance in Islamic legislation.
