Abstract
The distinction between what constitutes a jurisdictional issue and what relates to the merits of the case is not always an easy task for CAS Panels, where a lot of ‘hybrid’ situations arise and there is no categorical answer to these questions, not least because of the particularities of the appeal arbitration procedure.
