The primary legal materials used in this writing are the 1945 Constitution of the Republic of Indonesia, Law Number 5 of 1960 concerning Basic Agrarian Regulations, Government Regulation Number 24 of 1997 concerning Land Registration, and Government Regulation of the Republic of Indonesia Number 18 of 2021 concerning Management Rights, Land Rights, Flats Units, and Land Registration and Presidential Instruction Number 1 of 2022 concerning Optimization of the Implementation of the National Health Insurance Program. As for secondary legal materials in the form of publications on law including text books, legal dictionaries, legal journals, and comments on court decisions. The tertiary legal materials used in this study are the Big Indonesian Dictionary and the Legal Dictionary. Abstract

This article aims to analyze and examine the legal certainty of the prerequisites for the BPJS card in transferring land rights and the legality of transferring land rights without attaching a BPJS card after Presidential Instruction No. 1 of 2022. BPJS在土地权利流转中的法律确定性要求
本文旨在分析和考察2022年第1号国家主席批示后,BPJS卡转让土地权利先决条件的法律确定性,以及不附BPJS卡转让土地权利的合法性。本文采用规范的法学研究方法。本研究的性质是描述性分析。本文中使用的主要法律材料是1945年印度尼西亚共和国宪法,1960年关于基本农业条例的第5号法律,1997年关于土地登记的第24号政府条例,以及2021年关于管理权、土地权、公寓单位的第18号印度尼西亚共和国政府条例。土地登记和关于优化实施国家健康保险方案的2022年第1号总统指示。至于法律出版物形式的二手法律资料,包括教科书、法律词典、法律期刊和法院判决评论。本研究使用的三级法律资料是《大印尼语词典》和《法律词典》。研究结果表明,法律确定性是BPJS卡进行土地权利转让的先决条件,即政府没有实现法律确定性的某些方面作为BPJS卡进行土地权利转让的先决条件,而法律法规必须得到一致和相应的执行。
