PERIZINAN BERUSAHA MELALUI ONLINE SINGLE SUBMISSION SEBAGAI KETAATAN HUKUM DALAM RANGKA MENINGKATKAN INVESTASI

Abstract

AbstrakOnline Single Submission (OSS) adalah sistem pengintegrasian perizinan usaha secaraelektronik. Sistem ini memberikan layanan elektronik secara online system kepadainvestor/ pelaku usaha. Metode penelitian adalah penelitian hukum deksrptif empiris.Rumusan masalah kajian tulisan ini adalah bagaimanakah prosedur perizinan berusahamelalui sistem OSS dan apa akibat hukum bagi pelaku usaha apabila tidak memenuhiKomitmen Berusaha. Hasil penelitian ini menunjukkan bahwa prosedur perizinanmelalui OSS memberikan kemudahan dan dapat diakses dimanapun berada, sehinggamempermudah investor dalam mengajukan izin. Ada tiga model yang ditawarkan bagipelaku usaha dalam mengakses OSS yaitu sistem mandiri, pendampingan dan prioritas.Namun izin usaha yang sudah diberikan di awal kegiatan usaha dapat dibatalkan apabilapelaku usaha tidak memenuhi Komitmen berusaha dalam batas waktu yang telahditentukan. Pernyataan Komitmen dari investor menjadi konsep kemudahan perizinanyang diberikan oleh sistem OSS. Pemenuhan komitmen pada izin usaha bersifat mutlakdan akan berakibat pencabutan izin usaha awal sehingga memberikan dampak investortidak dapat melanjutkan usahanya.Kata Kunci : Perizinan berusaha, investor, OSS Abstract Online Single Submission (OSS) is an electronic business licensing system. This systemprovides online electronic system services to investors / business people. The researchmethod is empirical descriptive legal research. The formulation of the problem of thispaper review is how the licensing procedure is attempted through the OSS system andwhat are the legal consequences for business actors if they do not meet the BusinessCommitment. The results of this study indicate that licensing procedures through OSSprovide convenience and can be accessed wherever they are, making it easier for investorsto apply for permits. There are three models offered for business people in accessing OSS,namely an independent system, assistance and priority. However, a business license thathas been granted at the beginning of a business activity can be canceled if the businessactor does not fulfill the business commitment within the specified time limit. Statement ofCommitment from investors becomes the concept of licensing convenience provided by theOSS system. Fulfillment of the commitment to the business license is absolute and willresult in the revocation of the initial business license so that the impact of investors can notcontinue their business.Keyword : Business licensing, investors, OSS
