Оn the problem of the use of unmanned underwater vehicles in the practice of detection, investigation and prevention of crimes

Abstract

В статье рассматриваются вопросы использования беспилотных подводных аппаратов (БПА) правоохранительными и государственными органами при пресечении и расследовании уголовных правонарушений, нормы уголовно-процессуального законодательства Республики Казахстан, регулирующие использование технических средств в уголовном процессе, научные публикации исследователей о применении беспилотных аппаратов. При изучении литературы удалось выявить ряд преступлений, где правоохранительные и государственные органы могли бы применить БПА. При этом практически нет комплексных исследований, охватывающих юридические основания использования БПА в ходе расследования уголовных дел и практические аспекты их применения. Автор предлагает органам уголовного преследования использовать беспилотные подводные аппараты при расследовании уголовных правонарушений в сфере незаконного оборота наркотических средств, браконьерства, преступлений в нефтегазовой отрасли, а также применять их по общеуголовным правонарушениям для поиска орудий преступления (спрятанных, скрытых) под водой. Методологической основой исследования являются общетеоретические и специально-юридические методы, которые в совокупности позволили раскрыть основные вопросы применения беспилотных подводных аппаратов при расследовании уголовных дел. По результатам исследования обращено внимание на практику применения беспилотных летательных и подводных аппаратов за рубежом в качестве криминалистического обеспечения расследований преступлений. Выработаны предложения для совершенствования действующего законодательства. The article deals with the use of unmanned underwater vehicles by law enforcement and government agencies in the suppression and investigation of criminal offenses, the norms of the criminal procedure legislation of the Republic of Kazakhstan regulating the use of scientific and technical means in criminal proceedings, scientific publications of researchers on the topic under study in the field of the use of unmanned vehicles. When studying the literature, it was possible to identify a number of crimes where law enforcement and government agencies could use unmanned underwater vehicles. At the same time, complex works covering the legal grounds for the use of unmanned underwater vehicles during the investigation of criminal cases and practical aspects of the use of these devices as scientific and technical means for a certain category of cases have not been sufficiently studied. Nevertheless, it is proposed to the criminal prosecution authorities about the possibility of using unmanned underwater vehicles in the investigation of criminal offenses in the field of illicit drug trafficking, poaching, oil and gas industry, as well as their use for ordinary criminal offenses to search for instruments of crime (hidden, hidden) under water. The methodological basis of the research is general theoretical and special legal methods, which together allowed to reveal the main issues of the use of unmanned underwater vehicles in the investigation of criminal cases. According to the results of the study, the attention of state and law enforcement agencies was drawn to the practice of using unmanned aerial vehicles and underwater vehicles by state and law enforcement agencies of foreign countries in the process of criminalistic support of crime investigations, as well as to develop new proposals for improving existing legislation.
