Abstract

The proportionality principle is a constitutional principle that has a constitutional basis and effect. It is generally agreed that the principle of proportionality consists of four partial principles: the principle of justification for the end, the principle of suitability of means, the principle of minimal harm, and the principle of balance of legal interests. The principle of proportionality is embodied in the principle of prohibition of excessively abundant restriction and the principle of excessively deficient protection in accordance with legal interests guaranteed by constitutional rights.
