Abstract

This article analyzes the impacts of the decision of the Federal Supreme Court-STF declaring the unconstitutionality of Law 1516/2015 of the municipality of Novo Gama (GO). In a democratic state, the basis of education must be the search for a fair, egalitarian, inclusive society, free from violence and prejudice. At this juncture, the Attorney General's Office filed an action for the Allegation of Non-compliance with a Fundamental Precept against the law of the municipality of Novo Gama-GO, which prohibited the use of any material that referred to gender in schools, under the prism that the law The aforementioned contradicted the fundamental rights advocated in CF/88, in addition to usurping the Union's competence to legislate on the country's educational base. At this point, it was possible to observe that the organizational context of Brazilian society still adheres to the patriarchal culture, political entities usurp fundamental rights and guarantee the preponderance of inequality in society. Thus, this decision by the STF is very important to foster the creation and implementation of public policies aimed at guaranteeing gender equality in the Common Curriculum Base.
