Fato do príncipe e teoria da imprevisão entre o Brasil e a França - Prince's fact and theory of imprevision between Brazil and France

Abstract

Resumo: O artigo critica e revê a influência francesa sobre a teoria do fato do príncipe e a teoria da imprevisão no Brasil por meio da hipótese de que, nesses institutos, não houve completa assimilação da tradição francesa, de tal forma que o direito brasileiro consagrou regime jurídico mais favorável ao particular. Para isso, compara as disciplinas jurídicas de ambos os países e se conclui não só pela existência de relevantes diferenças entre os regimes jurídicos, mas também entre as culturas jurídicas. Abstract: The article criticizes and revisits the french influence on the theory of the fact of the prince and the theory of the unpredictability in Brazil through the hypothesis that, in these institutes, there was not a complete assimilation of the French tradition, in such a way that the Brazilian law has a legal regime more favorable to the individual. To do so, it compares the legal disciplines of both countries and concludes not only because of the existence of relevant differences between legal regimes but also between legal cultures.
