Abstract

This is a seminal issue in terms of the drafting of the Unit Titles Act 2010 (NZ). It is a critical issue as body corporate committees that exceed their statutory powers may be found to have acted ultra vires the legislation and therefore become personally liable for the actions of the body corporate.
