Rethinking the Notion of Uniformity in the Drafting of International Commercial Law: A Preliminary Proposal for the Development of a Policy-Based Unification Model

Abstract

This article sketches the need for distinction between the unification of rules reflecting public policy and rules embodying legal constructs, and the adverse implications if failure to do this, which an alternative model of international commercial law reform would avoid. Benefits and foreseeable objections to this alternative model are considered.
