PERLINDUNGAN HUKUM TERHADAP ANAK YANG MENJADI KORBAN TINDAK PIDANA

Abstract

Pasal 44 UU Nomor 23 Tahun 2002 Pasal 1 butir 1 Undang-Undang tersebut menjelaskan bahwa perlindungan bagi anak adalah upaya menjamin dan melindungi anak dan hak-haknya agar dapat hidup, tumbuh, berkembang, dan berpartisipasi, secara optimal sesuai dengan harkat dan martabat kemanusiaan, serta mendapat perlindungan dari kekerasan dan diskriminasi. Hasil penelitian menunjukkan bahwa anak perlu mendapatkan Perlindungan Hukum. Anak sebagai generasi penerus bangsa merupakan modal sumberdaya manusia bagi pembangunan nasional. Penegakan hukum terhadap anak akibat tindak kekerasan angat diperlukan guna kelangsungan hidup mendatang yang didukung oleh lapisan masyarakat. Penegakan hukum perlu diupayakan guna mengembalikan kepercayaan masyarakat terhadap hukum, karena masyarakat merupakan faktor yang sangat berperan mendukung penegakan hukum. Sebagimana dalam Undang-undang Nomor 23 Tahun 2002 tentang perlindungan anak anak perlu dijamin dan dilindungi hak-haknya agar dapat hidup, tumbuh, berkembang, dan berpartisipasi secara optimal sesuai dengan harkat dan martabat kemanusiaan. ABSTRACT The research with the title Legal Protection of Children who are Victims of Criminal Actions aims to find out how legal protection is for children who are victims of criminal acts and how the efforts and steps and anticipatory solutions of law enforcement in reducing children who experience victims violent crime. Violence against children is a painful act, both physically and emotionally. Violence against children can cause harm to children both physically and emotionally. Child abuse is an act of injuring that is carried out repeatedly physically and emotionally against children through the urge of desire, corporal punishment, degradation and ridicule or sexual violence. Provision of facilities, implementation and comprehensive health efforts from the government is mandatory for children. Children must obtain optimal health degrees since they are still in the womb. Article 44 of Law Number 23 of 2002 states that Article 1 point 1 of the Law explains that protection for children to guarantee and protect children and their rights so that they can live, grow, develop, and participate optimally by their dignity and status. human dignity, and receive protection from violence and discrimination. The results showed that children need to get legal protection. Children as the nation's next-generation are human resource capital for national development. Law enforcement against children as a result of acts of violence is a which is very necessary for future survival that is supported by all levels of society. Law enforcement needs to be pursued to restore public confidence in the laws that apply in Indonesia because the community is a factor that plays an active role in supporting the law enforcement process. As stated in Law Number 23 of 2002 concerning the protection of children, their rights need to be guaranteed and protected so that they can live, grow, develop, and participate optimally by human dignity.
