Abstract
This article discussed the phenomenon of over-declaration, how it may appear troubling at first glance considering the significant gap created between the number of so-called disclosed (potentially essential) patents and the patents that are truly essential to the standard, and how this over-declaration should not be cause for concern as long as access to SEPs under FRAND terms and conditions is guaranteed.
