This article is intended to compare the application of judicial emergency in the United States and how it reflects on judicial power in Indonesia. This study uses the comparative constitutional law method which is to compare the material of constitutional law and practice in other countries to take the best materials and practices and provide suggestions that should be avoided in positive constitutional law. Abstract

The determination of a state of emergency clearly affects not only the executive and legislative branches of power but also the judicial power. The establishment of a state of emergency for the COVID-19 Pandemic in various countries has a direct or indirect effect on judicial powers in carrying out their duties and functions. This article is intended to compare the application of judicial emergency in the United States and how it reflects on judicial power in Indonesia. 美国和印度尼西亚的Covid-19大流行的司法紧急管理比较
紧急状态的确定显然不仅影响到行政和立法权力部门,而且影响到司法权。各国因新冠肺炎疫情进入紧急状态,对司法权履行职责产生直接或间接影响。本文旨在比较美国司法紧急状态的适用,以及它对印度尼西亚司法权的影响。本研究采用比较宪法学的方法,即比较各国宪法的材料和实践,采取最好的材料和实践,并提出实证宪法学中应避免的建议。本文的结论是,印度尼西亚的司法权力法和程序法中需要有严格的法律材料,以便在处理司法部门的紧急情况时不会赋予太多的技术权力。
