ANALISIS PENYEBAB TERJADINYA PENYIMPANGAN WEWENANG TUKANG GIGI/ AHLI GIGI BERDASARKAN PERMENKES NOMOR 39 TAHUN 2014 TENTANG PEMBINAAN, PENGAWASAN DAN PERIZINAN, PEKERJAAN TUKANG GIGI

Abstract

AbstrakTukang gigi merupakan orang yang memiliki kemampuan membuat dan memasang gigi tiruan lepasan yang terbuat dari bahan akrilik, berdasarkan Peraturan menteri kesehatan Nomor 39 Tahun 2014 tentang Ahli Gigi. Fakta di lapangan menunjukan pembatasan wewenang tukang gigi tidak sejalan dengan keadaan, di mana permintaan dari masyarakat menengah ke bawah tidak dapat di hindarkan. Fokus bahasan ini mengarah pada penyebab terjadinya penyimpangan wewenang tukang gigi/ ahli gigi berdasarkan peraturan Menteri Kesehatan nomor 39 tahun 2014 tentang pembinaan, pengawasan dan perizinan, pekerjaan tukang gigi. Tujuan penelitian ini adalah mengkaji penyebab terjadinya penyimpangan yang di lakukan tukang gigi berdasarkan Peraturan Menteri Kesehatan Nomor 39 Tahun 2014 tentang Pembinaan, Pengawasan, dan Perizinan Pekerjaan Tukang Gigi. Penelitian yang dilakukan oleh penulis yaitu secara normatif dengan pendekatan Statue Approach perundang-undangan dilakukan dengan mengkaji berbagai peraturan perundang-undangan atau yurisprudensi terkait isu hukum yang di teliti. Hasil penelitian ini, dalam menentukan faktor penyebab penyimpangan ialah faktor ekonomi masyarakat, keadaan tanpa adanya pengawasan dari Dinas Kesehatan, ketentuan yang di canangkan menjadi penyebab penyimpangan para tukang gigi. Dinas Kesehatan belum memiliki program yang terstruktur untuk menanggulangi permasalahan tersebut.Kata Kunci: Penyimpangan, Tukang Gigi, Wewenang.AbstractA dentist is a person who has the ability to make and install removable dentures made of acrylic material, based on the Minister of Health Regulation No. 39/2014 on Dentists. The facts in the field show that limiting the authority of dental artisans is not in line with the situation, where requests from the middle and lower classes cannot be avoided. The focus of this discussion is directed at the causes of deviations in the authority of dental artisans / dentists based on the Minister of Health regulation number 39 of 2014 concerning coaching, supervision and licensing, dental work. The purpose of this study was to examine the causes of irregularities committed by dental artisans based on the Minister of Health Regulation Number 39 of 2014 concerning Dentist Work Guidance, Supervision and Licensing. Research conducted by the author is a normative approach to the statutory Statue Approach by examining various statutory regulations or jurisprudence related to the legal issues under study. The results of this study, in determining the factors that cause deviation are the economic factors of the community, the situation without supervision from the Health Office, the provisions that have been announced are the causes of deviations by dental artisans. The Health Office does not yet have a structured program to deal with these problems.Keywords: Authority, Dentist, Deviation.
