We find that overburdened judges take shortcuts, such as using focal points and cues, resulting in harsher sentences. Abstract

Policymakers and scholars repeatedly warn that frequent and persistent judicial vacancies pose one of the greatest threats to the federal judiciary by overburdening judges.
