Economic and fiscal crises in the 80s and 90s disorganized Sibrater, which collapsed, at the same time that private service providers became more numerous. Through a bibliographic and documentary research, with a descriptive objective, the article aims to analyze the main legal frameworks and public policies that encourage and condition the public and private offer of Ater services. Among the results of the analysis, it is possible to affirm that the 21st century, especially the second decade, faced a reorganization of the system, with the creation in law of a national policy and an executive agency to implement it, in parallel with an increasing fund supplies, at least until 2015, when a new economic and fiscal crisis weakened the state capabilities.
