摘要

本研究试图回答在证明腐败国家财政损失要素计算过程中存在的法律问题是什么?刑事司法系统中国家经济损失构成要件计算证据中存在的法律问题又如何解决?研究为规范研究。在研究的基础上，可以得出结论，法律制度的问题涉及到对国家财政不利的腐败行为的执法中的法律实质问题和对国家财政不利的腐败犯罪行为的执法中的法律结构问题。
