Research on the Copyright Protection of Open Source Code and Its Derivative Software Works Based on Internet and Information Technology

Most of the open source code adopts the GPL agreement, that is, derivative software works developed using open source code must recognize the copyright of the software work author, and at the same time, the author must allow anyone to enjoy the freedom to use, copy, modify, and derive his work. However, this limitation inevitably leads to judicial disputes because of the lack of relevant applicable principles and legislative basis. The article believes that it has the dual attributes of deductive works and cooperative works, and then analyzes the corresponding copyright ownership and exercise, and specifically elaborates how to define whether it constitutes copyright infringement in judicial practice. If we can improve the corresponding legal system and establish a dispute prevention mechanism for open source software activities, it will bring huge benefits to the development of open source software and the entire network industry.
