本文从教育领域法人的组织形式和法律形式两个方面，结合宪法规范和示范立法的指导规范，对教育与民事立法规范的协调问题进行了评述。它考察了法人实体在教育领域的组织和机构的法律形式，即自治的非营利组织的优势和劣势。从加强教育立法的角度，对教育领域法人的组织形式和法律形式的界定提出了解决问题的思路。
