Such relations were and have been treated by the State as a crime against the Indians. This article, based on the concrete case study, analyzes the nature of these relations, considering the perspectives of each actor, taking into account the historical, geographical, economic and anthropological aspects, concluding by the misconception of the relation object of the study criminalization, which replicates old prejudices and stereotypes, being insufficient the approach of the Criminal Law to understand and confront the issue.
