The working hypothesis laid out in this paper is that the right of the prosecutor to unilaterally restrict the defense right to access the case file during the investigation and to unilaterally decide which evidence he will use as the basis for the indictment does not satisfy the requirements stemming from the right to a fair trial. The starting point of this paper is the analysis of the case law of the European Court of Human Rights. Afterward, the paper turns to the consideration of the provisions of the criminal procedural legislation of Bosnia and Herzegovina dealing with the restrictions of the right to inspect the case file. In that purpose, this paper employs normative and formal dogmatic legal methods in analyzing the particulars of its subject. The conclusion of the paper is that the law of Bosnia and Herzegovina when it comes to the restrictions of the right to inspect the case file is not in line with the standards of the European Court of Human Rights. 摘要

本文旨在评估波斯尼亚-黑塞哥维那刑事诉讼立法中关于限制查阅案卷权利的规定是否符合欧洲人权法院判例中制定的标准。本文提出的工作假设是,检察官在调查过程中单方面限制辩护人查阅案卷的权利和单方面决定起诉依据的权利不符合公平审判权的要求。本文的出发点是对欧洲人权法院判例法的分析。随后,本文转向审议波斯尼亚和黑塞哥维那刑事诉讼立法中关于限制查阅案卷权利的规定。为此,本文采用规范性和形式教条式的法律方法来分析其主体的具体情况。本文的结论是,波斯尼亚和黑塞哥维那的法律在限制查阅案卷的权利方面不符合欧洲人权法院的标准。因此,有必要修订波斯尼亚-黑塞哥维那现行的《刑事诉讼法》,以便使这些法典符合欧洲人权法院在这方面的判例。
