Such an investigation may disrupt the market participants' activities and reduce their competitiveness, which is contrary to the key goals of the competition law. This paper analyzes sources of law for the unannounced investigation in the European Union (EU) competition law and Serbian law, as well as the practice of conducting unannounced investigations in EU member states and Serbia. 摘要

如果有理由怀疑违反竞争法的证据可能被销毁或篡改,中国竞争保护委员会(CPC)有权对市场参与者的场所进行检查,而无需事先通知或任何法院命令,甚至无需有效的事后控制。这种调查可能会扰乱市场参与者的活动,降低他们的竞争力,这与竞争法的主要目标背道而驰。本文分析了欧盟竞争法和塞尔维亚法中暗访调查的法律渊源,以及欧盟成员国和塞尔维亚开展暗访调查的实践。根据研究结果,结论是塞尔维亚应通过对《竞争法》的修订,以及对中国共产党权力和义务的规定,从而通过统一适用竞争法来减少中国共产党在相同或类似案件中的行为差异,有效保护竞争,减少市场参与者的法律不确定性,目前市场参与者的法律不确定性明显高于欧盟成员国。
