Breve análisis jurídico de la Sentencia del Tribunal Supremo nº 1215/2021 con motivo del Recurso Contencioso-Administrativo 202/2020, interpuesto contra el Real Decreto 542/2020 por la Asociación de Empresas de Energía Eléctrica (AELEC) por el que se incorporan las exigencias de cumplimiento del Real Decreto 1432/2008 de Protección de Avifauna en cuanto a las verificaciones e inspecciones y verificaciones trienales de las líneas e instalaciones eléctricas. Asunción por parte del Tribunal Supremo de las exigencias de la Ley 26/2007 de Responsabilidad Medioambiental por considerar que el riesgo de electrocución y colisión de aves es inmediato y se puede producir en cualquier momento independientemente de que la línea se encuentre dentro o fuera de las Zonas de Protección definidas en el artículo 4 del Real Decreto 1432/2008.
