摘要

本文从现代立法和学说的角度阐述了“法庭之友”的含义，以及它在罗马法和英国法中的渊源。文章的一部分专门讨论国际机构在法庭之友方面的现行法律地位及其在世界各地不同法律制度中的地位。此外，文章的最后一部分涉及到分析新的法庭之友概念在乌克兰立法中，结合新的司法案件管理原则和民事诉讼中法官和当事人的合作。文章最后以乌克兰和其他东欧国家民事诉讼制度改革为例，对其在大陆法系国家实施的必要性和可行性进行了思考。
