摘要

由于立法者认为政府采购合同的订立过程中不涉及行政权的行使,现行制度规定,在政府采购引起的纠纷中,供应商可以根据合同前阶段和合同履行阶段的不同,诉诸行政诉讼或民事诉讼。但是,无论是民事性质还是行政性质的政府采购合同,甚至是在履行过程中产生的合同纠纷,仍然涉及到行政目的的考量,需要在司法审查过程中注意“权力控制”和对公共利益的保护。因此,行政诉讼因其客观诉讼性质,比民事诉讼更适合于政府采购合同纠纷的司法审查。

Administrative Litigation of Government Procurement Contract Dispute
