L’individuo al cospetto del potere disciplinare

Il potere disciplinare, malgrado la sua essenza punitiva, non è regolato per proteggere la posizione del singolo colpito dalla sanzione. È infatti sbilanciato a favore della comunità nella quale si esplica. Ne sono riprova l’atipicità delle infrazioni, l’applicazione di norme vaghe e indeterminate, la peculiare composizione delle autorità disciplinari, i limiti del sindacato giurisdizionale. Si pone così un problema di compatibilità del fenomeno con l’ordine costituzionale. Disciplinary power, despite its punitive essence, is not regulated to protect the position of the individual affected by the sanction. It is in fact biased in favor of the community in which it is expressed. This is demonstrated by the atypical nature of the infringements, the application of vague and indeterminate rules, the particular composition of the disciplinary authorities and the limits of judicial review. This raises a problem in terms of compatibility of the phenomenon with the constitutional order.
