LA MEDIACIÓN FAMILIAR EN LAS CRISIS MATRIMONIALES; EN PARTICULAR, LA PENSIÓN COMPENSATORIA COMO OBJETO DE CONTROVERSIA

La mediacion es un proceso al que voluntariamente pueden acudir las partes para intentar establecer los terminos de su divorcio de mutuo acuerdo, que pretende reducir los danos emocionales derivados de la separacion o divorcio, proteger los intereses de los menores que pudieran estar implicados y minimizar los desacuerdos de los conyuges. En este estudio se hace referencia, en particular, a la pension compensatoria como objeto del proceso de mediacion, poniendo de relieve los aspectos controvertidos de este extremo del divorcio y las posibles soluciones a alcanzar mediante la mediacion. EnglishUntil the adoption of the national and regional legislation in the field of family mediation, the resolution of conflicts arising from marital crises had be solved in the judicial field. Mediation is a process in which the parties voluntarily try to establish the terms of their divorce by mutual agreement, seeking to reduce the emotional harm arising from the separation or divorce, to protect the interests of minors who may be involved and to minimize the disagreements of the spouses. In this paper we analyse, in particular, the compensatory pension as an object of the mediation process, highlighting the controversial aspects of this element of the divorce and the possible solutions to be achieved through mediation.
