{"title":"Police–Advocacy Partnerships in Response to Domestic Violence","authors":"Carla Smith Stover","doi":"10.1080/15332586.2012.717031","DOIUrl":"https://doi.org/10.1080/15332586.2012.717031","url":null,"abstract":"Police–social service second responder programs like the Domestic Violence Home Visit Intervention (DVHVI; Berkman, Stover, & Marans, 2006) have been developed in multiple cities around the country in an attempt to reduce recidivism following an initial report of intimate partner violence to police. Although data do not support impact of these programs on repeat violence, they do serve important functions. Surveys with victims in this study of the DVHVI reveal that victims feel safer and have increased comfort with police and result in more accurate reporting of repeat violence to police when incidents do occur. Victims feel the police and other service providers in the community are concerned about their well-being and are available to assist them. This kind of coordinated second responder outreach is particularly helpful for Hispanic, Spanish-speaking victims when they are served by Spanish-speaking second responder teams. Although application of this model by police has reduced serious and fatal partner violence, it has not significantly improved the long-term prospects of battered women. This article argues that the limited effectiveness of the criminal justice response stems less from failures in policing than from a large gap that separates the violent incident model guiding the current response from the pattern of coercive control that drives most victims to seek police or other outside assistance. The authors argue that four general presuppositions about domestic violence need to be reexamined to develop adequate police training that enhances detection, investigation, and prosecution of these crimes. Chief among these presuppositions are: (a) there is only one kind of domestic violence; (b) most domestic violence is relatively minor; (c) domestic violence is the same as other crimes; and (d) domestic violence calls are extraordinarily dangerous for police officers. The traditional police response could best be characterized by a desire to avoid intervention in family disputes and to avoid arrest whenever possible. Police socialization and culture, statutory restrictions on misdemeanor arrest, organizational disincentives, and lack of department policies and training were all reflective of a broader societal indifference. Beginning in the late 1960s and early 1970s, there came political and legal pressure from women’s rights and battered women advocates, research, and organizational concerns over the possibility of liability if the police continued past practices of neglecting these victims. Initial efforts focused on crisis intervention as proposed by New York City police psychologist Morton Bard (1967, 1973). The National Institute of Justice (NIJ) spent millions of dollars between 1971 and 1976 to provide in-service training for officers in more than a dozen police departments to encourage the use of Bard’s intervention. This approach was promoted by the International Association of Chiefs of Police and widely supported (Mohr & Steblein, 1976). However, the 1970s brought about skepticism as to the efficacy of rehabilitation widespread and a growth in support for the increased use of criminal sanctions for a variety of offenses. Domestic violence was no exception, and the focus shifted from keeping families intact to ensuring victim safety. The famous Minneapolis Domestic Violence Study by Sherman and Berk (1984) was used to further confirm the efficacy of arrest as a strategy for reducing domestic violence. As a result, domestic violence statutes and police policies nationwide shifted toward more proactive interventions, including not mandated, arrest. This article provides information and recommendations about evidence collection in domestic violence cases based on prosecutorial experience in Brooklyn, New York. It also provides the results of research showing the value of specific types of evidence for obtaining a conviction. In this study, the author explores the initial enthusiasm for these programs and claims of dramatic drops in homicides. He questions whether, like previously hailed criminal justice responses to intimate partner violence, LAPs will be found to offer only incremental improvement at best. Further, he suggests that lethality is a poor measure by which to judge criminal justice intimate partner violence interventions. In fact, he argues, current research suggests that the vast majority of victims may be more likely to die as a result of suicide than homicide.
