Metode penelitian hukum normatif. Pendekatan yang digunakan adalah pendekatan perundang-undangan dan pendekatan sejarah. Teknik pengumpulan bahan hukum menggunakan teknik studi kepustakaan. Seluruh bahan hukum yang telah terkumpul, selanjutnya dianalisis secara deksriptif. Hasil penelitian ini menyimpulkan bahwa: pertama, pengaturan bunga maksimal pada pinjaman online di perusahaan fintech adalah 0,8 persen perhari dan tidak boleh melebihi angka tersebut dan harus tertulis dalam perjanjian, sedangkan jika besaran bunga tidak diatur dalam perjanjian, maka besaran bunga mengacu pada Pasal 1250 KUHPerdata jo Lembaran Negara No.22/1948 (s.No.22/1848) yaitu 6% pertahun. This research uses normative legal research methods. The results of this study show that the comparison of authentic deeds according to the Law of Notary Position No.2 of 2014 and the Regulation of the Head of the Land Agency No.8 of 2012 regarding the creation of a power of attorney to impose mortgage rights made before a notary there are differences in the head and end of the deed. The form of power of attorney imposes a security right issued by the State Land Agency of the Republic of Indonesia which is different and not in accordance with the provisions stipulated in the Law of Notary Position No.2 of 2014. Second, the legal certainty of the power of attorney imposes a security right made by a Notary by following format of the Head of the Land Agency Regulation No.8 of 2012, the deed cannot provide legal certainty. The deed will be degraded into a letter under the hand, so that it cannot be used as a basis in making the deed of mortgage imposition, however, the Notary is given the right to add deficiencies to the blank so that it remains an authentic deed. \u0000  \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000  \u0000Tujuan penulisan ini untuk mengetahui mengenai kepastian hukum serta perbandingan surat kuasa membebankan hak tanggungan yang diatur dalam Undang-Undang Jabatan Notaris No.2 Tahun 2014 dengan Blanko yang ditentukan Peraturan Kepala Badan Pertanahan No.8 Tahun 2012. Penelitian ini menggunakan metode penelitian hukum normatif. Hasil penelitian ini menunjukan perbandingan akta autentik menurut Undang-Undang Jabatan Notaris No.2 Tahun 2014 dan Peraturan Kepala Badan Pertanahan No.8 Tahun 2012 dalam mengenai pembuatan surat kuasa membebankan hak tanggungan yang dibuat dihadapan Notaris terdapat perbedaan pada kepala dan akhir akta. Blanko surat kuasa membebankan hak tanggungan yang diterbitkan Badan Pertanahan Negara-Republik Indonesia berbeda dan tidak sesuai dengan ketentuan yang telah ditetapkan dalam Undang-Undang Jabatan Notaris No.2 Tahun 2014. Kedua, kepastian hukum surat kuasa membebankan hak tanggungan yang dibuat oleh Notaris dengan mengikuti format Peraturan Kepala Badan Pertanahan No.8 Tahun 2012 maka akta tersebut tidak dapat memberikan kepastian hukum. Normative legal research methods is uses for this writing. The result of this study indicates that Rural Banks and Commercial Banks have different positions in the purchase of a collateral execution auction. Only Commercial Banks that stipulated in Article 12 A paragraph (1) of the Banking Act can purchase an auction for the executions of mortgage guarantees, while Rural Banks cannot become buyers in the auction for executions of collateral for their collateral. \u0000  \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000Tulisan ini bertujuan untuk mengembangkan keilmuan dalam bidang hukum kenotariatan dan untuk mengetahui perbedaan kedudukan hukum antara Bank Perkreditan Rakyat dengan Bank Umum termasuk didalamnya Bank Pembangunan Daerah sebagai pembeli dalam lelang eksekusi hak tanggungan atas jaminannya. Penelitian ini menggunakan metode penelitian hukum normatif. Hasil penelitian ini membuktikan bahwa Bank Perkreditan Rakyat dengan Bank Umum memiliki perbedaan kedudukan dalam pembelian lelang eksekusi hak tanggungan atas jaminannya. The method of legal research in this journal applies normative legal research, with an approach to law and analysis of legal concepts. The results showed that Notaries were free to use any interpretation regarding which fingerprints to be used and were free to determine which fingerprints were affixed to those who were able to sign or only parties who were unable to sign. In this case, the notary must consistently do it during his / her duties. Regarding the consequences for the Notary for the minimum number of deeds with different fingerprints on the faces, it is not further regulated in the statutory regulations so that the Notary cannot be sanctioned due to the inconsistency. \u0000  \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000Tujuan dari tulisan ini yakni untuk mengetahui dan mengkaji tentang peran Notaris dalam menyikapi ketentuan pembubuhan sidik jari Para Penghadap dalam minuta akta  dan juga  mengetahui dan mengkaji konsekuensi bagi Notaris terhadap minuta akta yang pembubuhan sidik jari Penghadapnya berbeda-beda. Metode penelitian hukum dalam jurnal ini mengaplikasikan penelitian hukum normatif, dengan pendekatan UU dan analisis konsep hukum. Hasil penelitian menunjukkan Notaris bebas untuk menggunakan penafsiran manapun mengenai sidik jari mana yang akan dipakai dan bebas menentukan pembubuhan sidik jari dilakukan juga bagi Para Penghadap yang mampu untuk tanda tangan ataukah hanya penghadap/para pihak yang tidak mampu untuk tanda tangan. Dalam hal ini, Notaris harus konsisten melakukannya selama menjalankan tugas jabatannya. The research method applies a normative legal research. Results indicated that electronically checked documents, which examine based on the regulation stated in Article 1 paragraph 2 letter a of the Regulation the Minister of Agrarian 5/2017 which is where electronic certificate checking will replace manual certificate checking as regulated in the Regulation of the Head of the National Land Agency 8/ 2012. Legal responsibility related about errors in the results of checking certificates electronically is the responsibility of BPN in accordance with Article 10 paragraph (4) and paragraph (5) of the Regulation the Minister of Agrarian 5/2017 with legal responsibility in the form of clarification explanation and improvement of the database system. \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000Tulisan ini memiliki tujuan untuk mengetahui pengaturan pengecekan sertifikat secara elektronik dan mengkaji tanggung jawab Badan Pertanahan Nasional terkait ketidaksesuaian hasil pengecekan sertifikat dalam Permen Agraria 5/2017.  Penelitian ini menggunakan metode penelitian hukum normatif. The research of this normative law examined the norm that happens, such as a norm vacuum that does not regulate criminal sanctions in Laws of Notary. This research contained several sources, such as premier, secondary, and tertiary laws. Furthermore, the research approach was done by the conceptual approach that analyzes the concept of organizing violations by the notary. The result of this research was the Notary deed can be requested for the deed to be annulled based on the legally binding decisions determined by the District Court, then, the Notary Deed can be disqualified and can be avowed as the non-binding deed for the parties who made it. The sanctions of the Notary who falsified the data in making the authentic deed are, administrative sanction or the notary code of ethics, the sanction based on The Civil Law Code, and the sanction based on Criminal Code. The Notary can also be sued for compensation if the violation that is done by the notary causes a deed becomes an inauthentic deed and be relegated to the deed for who made it. This is the protection that can be given to the party if a Notary does not carry out the duties and obligations. \u0000 \u0000 \u0000 \u0000 \u0000Abstrak \u0000 \u0000 \u0000 \u0000 \u0000Tujuan penulisan ialah memberikan pemahaman terkait pengaturan ”tanggung jawab Notaris yang melakukan pelanggaran dalam menjalankan jabatannya serta”  memberikan perlindungan hukum yang diperoleh penghadap atas pemalsuan data yang dilakukan Notaris. Penelitian hukum normatif ini menelaah persoalan norma yang terjadi yaitu suatu kekosongan norma tidak diaturnya mengenai sanksi pidana dalam UUJN. Penelitian ini memuat sumber-sumber yaitu hukum bahan hukum primer, sekunder serta tersier. Selanjutnya, pendekatan penelitian dilakukan melalui pendekatan konseptual yang menganalisa konsep penyelenggaraan pelanggaran oleh Notaris. Hasil penulisan menunjukkan akta Notaris dapat dimintakan untuk akta dibatalkan, berdasarkan keputusan yang sudah berkuatan hukum tetap yang ditetapkan oleh pengadilan negeri tersebut maka akta Notaris dapat dibatalkan dan dinyatakan sebagai akta yang tidak mengikat bagi para pihak yang membuatnya. Adapun sanksi bagi Notaris yang melakukan pemalsuan data dalam pembuatan akta otentik ialah sanksi administratif atau Kode Etik Notaris, sanksi menurut hukum KUH Perdata, sanksi menurut KUH Pidana. Notaris juga dapat digugat ganti rugi apabila pelanggaran atau kesalahan yang dilakukan Notaris mengakibatkan suatu akta menjadi tidak otentik dan terdegradasi menjadi akta di bawah tangan. Metode penelitian yuridis normatif, memfokuskan pada kajian norma dan kaidah hukum. Hasil penelitian menunjukkan bahwa (1) Pada PP 82 Tahun 2012 menentukan bahwa tanda tangan secara elektronik sebagai alat autentikasi dan verifikasi. UU ITE Pasal 11 menentukan tanda tangan secara elektronik sah apabila sesuai UU. Dalam UUJN-P belum diatur secara mengkhusus mengenai tanda tangan secara elektronik. (2) Tanggungjawab notaris atas tanda tangan elektronik belum diatur secara normatif, dalam menjalankan jabatannya notaris dapat menerapkan asas praduga sah, yang memiliki kekuatan pembuktian sempurna selama tidak ada yang menyangkalnya, bila ada pemalsuan tanda tangan elektronik dikarenakan notaris tidak melihat secara langsung penandatanganan tersebut maka pembuktian dibebankan pada pihak penyelenggara sistem elektronik. Terhadap sertifikat hak tanggungan yang hilang, Kantor Badan Pertanahan meminta akta konsen roya yang dibuat dihadapan notaris sebagai penggantinya. Adanya kekosongan norma mengenai akta konsen roya ini karena tidak satupun ada peraturan maupun undang-undang yng mengatur secara jelas. Penelitian ini bertujuan untuk mengkaji dasaran dan kekuatan hukum dibuatnya “akta konsen roya. Penelitian hukum normative yang digunakan untuk penulisan ini. The research used a sample of the annual general meeting of shareholders of 32 public listed companies and 1 district court decision against the directors of a finance company on charges of falsifying company documents. This research uses judicial normative research method combined empirical data.
