For almost eight decades was dominated by the Industrial Conciliation and Arbitration Act (1894). With the passage of the Industrial Relations Act (1973) at the behest of the social partners , a significant shift in underlying philosophy has occurred. The full ramifications of this change have yet to develop. A survey was conducted in mid 1988 to ascertain the response of New Zealand enterprises to a Voluntary Code of Practice (1987) issued by the Advisory Council for Occupational Safety and Health. An attempt was also made to identify internal and external factors which might have influenced the decision to comply. This article reports the results of a survey of employer opinion on current union involvement in plant decision making and on future bargaining scope. Little current union involvement is reported in either operational decisions or more basic management strategy decisions. 'In rnany cases this has Inanifested itself in the form of a firm issuing Vhat is known as an employee repon to ·its staff. Typicall). an employee report summarises the factual information contained in the statutO'I)' annual report but does so in a simplified fonn 1hich is easier for non-accountants to understand. In addition. the employee r~eport often contains non-financial information Vhi·ch does not appear in the annual accounts nor in any other company publication. While un·ion negotiators may have access to dctail·ed accounting infonnation. the general rank and file etnr.Joyecs probably get most of their financial knovledge about 'the ent~erprise they 'NOrk for via an em ployee report. A recent study by Firth and Smith (1984) found that nearly one-half of publicly listed Nevl Zealand companies currently produce some form of e1nployee r·eport. Additionally. many of the New Zealand subsidiaries of 'larger overseas firms also issue such reports. ln spite of the large number of finns involved. there has not. until nov. been any fonnal a sessment of employee attitudes regarding such reports. That in itself is an unexceptionable statement: it is true of any industrial relations system. It is the source and nature of that dynanmic tension which characterises a particular system. In this country that source and nature is often seriously misunderstood. It is depicted by the media (for the obvious reasons associated with their position within the nexus of relationships which make up the dominant consciousness) and by most academic historians (largely implicitly as an inarticulate major premise) as an offensive attempt on the part of the unions to elbow their way into an inappropriate control role within the political and industrial culture and as a defensive response on the part of employer organisations and successive governments to prevent this. The source of this depiction and the reasons for its persistence are interesting but rather outside lhe scope of this paper although they deserve to be canvassed at some point. This paper examines the decision in Hennessey and discusses two aspects of procedural unfairness; the failure to follow an agreed procedure and the failure to allow the worker an opportunity to offer an explanation. It provides an overview of bargaining provisions specifically addressing: choice of representatives, authorisation, recognition, rights of access, negotiation and ratification and critically analyses how the legal institutions have interpreted bargaining provisions under the Act. It argues that the free market philosophy underpinning the new regime is fundamentally flawed and that \"free bargaining\" has failed to deliver a workable system. Contrary to the peripheral role envisaged by the Act for the \"new\" legal institutions they had little option but to intervene and assume a traditional role of balancing the competing interests of employer and employees.
