In 2022, the publication of the new Istanbul protocol for effective investigation and documentation of torture and cruel, inhuman or degrading treatment and punishment made it advisable to review the protocols for forensic medical performance in Spain. In recent years, especially promoted by the International Committee of the Red Cross (ICRC), the concept of ‘humanitarian forensic action’ has been developed, as opposed or complementary to criminal investigation, focused on alleviating human suffering and protecting the dignity of victims of armed conflicts and other catastrophic events. That type of investigations demands specialized education under the perspective of multidisciplinarity of forensic work, in the proper application of international protocols and guidelines (Istanbul, Minnesota) and the recognition of the rights of victims and families. The Istanbul Protocol is the reference guide for the effective investigation and documentation of torture. An updated version (PE-2022) was published in June 2022. The objective of this article is to present the most relevant forensic aspects of the new version. Many of the principles contained are also of interest for forensic expert reports on other victims, such as those of intimate partner violence against women. As in these victims, an integral and multidisciplinary approach is contemplated. The updated version has 8 chapters and 4 annexes. The most interesting chapters for forensics are IV, V and VI. General considerations related to interviews, ethical obligations, the structure of the expert report, and physical and psychological evaluations are addressed. The physical assessment is part of the comprehensive evaluation. The evaluation should not be limited to the detection of external injuries. The psychological evaluation can be complex, and the collaboration of psychologists, psychiatrists or neurologists is useful. In the report, forensic physicians and psychologists must provide an assessment of the level of global consistency between the findings of the clinical evaluation (physical and psychological) and the torture report. The Institutes of Legal Medicine and Forensic Sciences must guarantee effective practices for the qualified investigation of torture, including proper training of forensic experts.among the differential diagnoses in cases of sudden death, especially in adolescents and young adults. It will address, first, main problems and challenges affecting these children with mental health problems, taking into account the experience of the Ombudsman’s Office in the complaints received from those affected, their families or associations in the sector. Claims that, on the other hand, have been increased after the pandemic caused by Covid-19. Protecting and defending the rights of children also involves formulating proposals for improvements to be taken into consideration by public administrations. Asi, vemos que algunos MET piensan que aunque el numero de negativas judiciales en la extraccion de organos sea pequeno, su trascendencia en el numero de receptores es importante, pudiendose establecer dudas sobre la justificacion etica a que una posible sobreproteccion de los procedimientos judiciales impida salvar vidas. Tambien se da la circunstancia contraria: algunos MF opinan que el explante de organos puede imposibilitar la determinacion de la causa de la muerte en determinados casos. No son pocos, sin embargo, los facultativos de ambos equipos que opinan que los objetivos de la donacion de organos y la recoleccion de pruebas forenses no son mutuamente excluyentes. La comprension de los problemas que se plantean, a una y otra parte, unido a un afan de colaboracion adecuado, pueden disminuir el numero de negativas.
