Abstract

A new ruling in the long-running Wit v. United Behavioral Health (UBH) case has reaffirmed that United Behavioral Health (UBH) violated its fiduciary duties under the Employee Retirement Income Security Act (ERISA) by prioritizing its own financial interests over those of plan members. U.S. District Judge Joseph Spero found that UBH breached its “duties of loyalty and care” when it used internal coverage guidelines that favored cost containment over patient care between 2011 and 2017.
