Supreme Court upholds FDA denial of plan to market flavored vapes

Abstract

The U.S. Supreme Court this month unanimously overturned an appellate court ruling that the Food and Drug Administration (FDA) had acted improperly in denying two companies' applications to market flavored vaping products. The Supreme Court's decision could prove to have greater relevance to the health care regulatory process during the current administration than to the e-cigarette market.
