Abstract

Although Title IX has long been familiar to college athletics, the name, image, and likeness enterprise may forever change our equity calculus in yet-to-be-determined ways. Title IX saw substantial changes in 2024 with the Biden administration's new regulations, but proposed athletic-specific regulations were never implemented. Now, the 2024 regulations have been vacated by a federal court in Kentucky and even more changes loom with a new presidential administration. Meanwhile, the world of NIL has burgeoned, introducing a new and dynamic array of policy and practice quandaries.
