A TV JUSTIÇA E OS PRECEDENTES JUDICIAIS: IMPACTOS E ALTERNATIVAS “TV JUSTIÇA” AND JUDICIAL PRECEDENTS: IMPACTS AND ALTERNATIVES

Abstract

Resumo: O artigo, a partir de uma revisão bibliográfica, salienta que a TV Justiça pode afetar a deliberação entre os ministros do Supremo Tribunal Federal (STF) e ocasionar a exposição exacerbada de sua imagem individual, trazendo impactos negativos para o fortalecimento dos precedentes judiciais. Inicialmente, contrapõe as vantagens e desvantagens dos modelos de deliberação aberto e fechado, e explicita as peculiaridades do modelo de publicidade adotado pelo plenário do STF, especialmente com a TV Justiça. Após, destaca que a TV Justiça pode colaborar para a limitação da deliberação entre os ministros e para promoção de sua identificação individual. Por fim, realça como os possíveis efeitos da TV Justiça podem trazer impactos negativos para os precedentes judiciais, argumentando que, no contexto atual, cabe a Corte, para fortalecer os precedentes judiciais e sua imagem como instituição, aprimorar suas práticas deliberativas e de comunicação com a imprensa dentro de um modelo de publicidade.Palavras-chave: Supremo Tribunal Federal. Precedentes Judiciais. Abstract: The article, based on a bibliographic review, points out that TV Justiça can affect the deliberation among the ministers of the Brazilian Supreme Court (STF) and cause exacerbated exposure of their individual image, bringing negative impacts to the strengthening of judicial precedents. Initially, it opposes the advantages and disadvantages of open and closed deliberation models, and explains the peculiarities of the open model adopted by the STF plenary, especially with TV Justiça. Afterwards, it highlights that TV Justiça can collaborate to limit the deliberation between the ministers and to promote their individual identification. Finally, it highlights how the possible effects of TV Justiça can have negative impacts on judicial precedents, arguing that, in the current context, it is the Court's responsibility, to strengthen judicial precedents and its image as an institution, improve its deliberative practices and its communication with the press within an open model.Keywords: Brazilian Supreme Court.
