This paper will adopt empirical research method and comparative research method based on the data of previous court judgements and combined with the current relevant legal regulations. The objective of this research is to expose the problems in judicial practice by analysing the existing case judgments on the criminal law system of making and selling online game hacks, distinguishing different crimes according to the legal benefits, and providing corresponding suggestions. The results of the study reveal that there are different definitions of online game plug-ins, mismatches between legal and technical knowledge, unclear thresholds of offence, and confusing identification of crimes in the current judicial practice. To sum up, firstly, we can learn from the way of dealing with this problem in other countries. Secondly, the offence should be identified more accurately by making an accurate distinction between specific legal interests in practice. Abstract

The endless emergence of online game hacks affects the development environment of the entire online games, damaging the interests of the developers and operators while also hitting the enthusiasm of social innovation. This paper will adopt empirical research method and comparative research method based on the data of previous court judgements and combined with the current relevant legal regulations. The objective of this research is to expose the problems in judicial practice by analysing the existing case judgments on the criminal law system of making and selling online game hacks, distinguishing different crimes according to the legal benefits, and providing corresponding suggestions. 网络游戏黑客层出不穷,影响了整个网络游戏的发展环境,损害了开发商和运营商的利益,也打击了社会创新的积极性。本文将采用实证研究法和比较研究法,以以往法院判决资料为基础,结合现行相关法律规定。本研究的目的是通过分析制造、销售网络游戏黑客罪刑法体系现有的案件判决,根据法律利益区分不同的犯罪,并提出相应的建议,揭示司法实践中存在的问题。研究结果表明,当前司法实践中存在网络游戏外挂定义不统一、法律知识与技术知识不匹配、犯罪阈值不明确、犯罪认定混乱等问题。综上所述,首先,我们可以借鉴其他国家处理这一问题的方法。其次,在实践中应准确区分具体的法律利益,从而更加准确地识别犯罪。最后,从技术角度分析侵权的性质,并与法律深入结合,可以解决上述问题。
