REFERRAL BY THE PRELIMINARY INVESTIGATION BODIES OF MATERIALS ON THE ELECTI ON OF PREVENTIVE MEASURES TO THE COURT

Статья посвящена исследованию вопросов формирования должностным лицом, вынесшим постановление о возбуждении перед судом хода-тайства об избрании меры пресечения, материалов, его обосновывающих, анали-зируется порядок их направления в суд, оценивается необходимость уведомления об этом заинтересованных лиц. Автором аргументируется целесообразность за-конодательного закрепления права лиц, чьи конституционные права затрагива-ются, на ознакомление с такими материалами, а также предлагается порядок та-кого ознакомления. The article is devoted to the study of the issues of formation by the official who issued the decision to initiate a petition for the election of a preventive measure before the court, the materials justifying it, the procedure for their referral to the court is analyzed, the need for notification of interested persons is assessed. The author argues the expediency of legislating the right of persons whose constitutional rights are affected to familiarize themselves with such materials, and also suggests the procedure for such familiarization.
