LOS BOSQUES Y EL DESARROLLO RURAL EN LA COMUNIDAD AUTÓNOMA DEL PAÍS VASCO

Abstract

Este estudio versa sobre la regulación jurídica forestal de los Territorios Históricos del País Vasco partiendo de un análisis de la normativa forestal europea y de la española, tanto estatal como autonómica. Además de exponer las principales medidas de cada una de las Normas Forales de estos Territorios desde la más antigua, la de Álava, a la más moderna, la de Guipúzcoa, se procede a un estudio, por un lado, de las medidas de fomento que se encuentran incluidas en la normativa forestal de esos Territorios y, por otro lado, de aquellas medidas también incentivadoras pero que están reguladas en la Política de Desarrollo Rural en el contexto de la Política Agrícola Común. Espainiako araudian, estatukoa eta autonomietakoak hartzen dira kontuan. Lurralde historikoetako foru-arauetako neurri nagusiak azaltzen dira: zaharrena Arabakoa da; modernoena, berriz, Gipuzkoakoa. Bestalde, analisi bat egiten da, eta bertan, lurralde historiko horietako foru-araudietako sustapen-neurriak aztertzeaz gain, sustatzaileak diren, baina aldi berean, Nekazaritza Politika Bateratuaren esparruko Landa Garapeneko Politiketan dauden neurriak ere aztertzen dira. This paper deals with the forestry legal regime of the Historic Territories from the Basque Country by analysing in the first place the European and the Spanish (State and Autonomous Communities¿) rules on forests. In addition to expounding the main measures of every Norma Foral from these Historic Territories, beginning with the oldest, from Alava, and finishing with the newest, from Gipuzkoa, it is studied on the one hand the measures of promotion included in the forest rules in those Territories and on the other hand those other in like manner promotional measures that are set up in the Rural Development Policy within the context of the Common Agricultural Policy.
