البحـث الکلامی فی مؤلفــات الفقهــاء نهایة المطلب للجوینی أنموذجا

Abstract

ملخـــص هذه الدراسة عنیت ببیان وتوضیح أثر علم الکلام فی علم الفقه الإسلامی؛ وذلک من خلال استعراض هذا الأثر فی أهم کتب الفقه الإسلامی وموسوعاته، وهو: نهایة المطلب فی درایة المذهب، لإمام الحرمین عبد الملک بن عبد الله بن یوسف الجوینی الشافعی، المتوفى سنة: (478ه). وقد تبین لنا من هذه الدراسة أثر المسائل العقدیة والکلامیة فی معالجة بعض المسائل الفقهیة، وأن شخصیة إمام الحرمین الکلامیة کانت حاضرة فی معالجة هذه المسائل. وقد توزعت هذه المسائل العقدیة والکلامیة فی أربعة مباحث: مسائل مقدمات علم الکلام، ومسائل الإلهیات، ومسائل التکفیر، ومسائل الملل والمذاهب. ومن أهم نتائج هذه الدراسة: أن علم التوحید هو من أهم ما یطلب فی زماننا هذا، وأن تعلم علم الکلام أصبح من فروض الکفایات. أن مدارک الأحکام التکلیفیة لا تؤخذ من حیث التدقیق العقلی، بل تؤخذ مما یتناوله أفهام الناس، لا سیما ما یبنى الأمر فیه على معنى اللفظ. الکلمات المفتاحیة: البحـث الکلامی - مؤلفــات الفقهــاء- أثر علم الکلام- نهایة المطلب- الإمام الجوینی - مدارک الأحکام التکلیفیة Verbal research in the literature of jurists The end of the demand for Jouini model By: Prof: Khaled Hammad Hamoud elodwani Associate Professor at the Faculty of Basic Education In the State of Kuwait E.MAIL: Khaled5485@yahoo.com Abstract This study aims at clarifying the impact of speech science in the field of Islamic jurisprudence by reviewing this effect in the most important books of Islamic jurisprudence and its encyclopedias. This is the end of the requirement in the knowledge of the doctrine of the Imam of the Two Holy Mosques King Abdul Malik bin Abdullah bin Yusuf Al Juwaini Al Shafi'i, 478 e). This study shows us the impact of the doctrinal and theological issues in the treatment of some jurisprudential issues, and that the personality of the Imam of the Two Holy Mosques was present in dealing with these issues. These doctrinal and grammatical issues were divided into four topics: the issues of the precepts of speech science, questions of theology, questions of atonement, and questions of boredom and doctrines. The most important results of this study: 1. That the science of Tawheed is one of the most important demands in our time, and that learning the science of speech has become one of the competencies of competencies. 2 - The perception of the provisions of the mandate is not taken in terms of mental scrutiny, but taken from what is addressed by the people, especially what is built on the meaning of the word..
