Abstract

- The purpose of the research was to find out the causes of discrepancies in land sale and purchase agreements based on the Civil Code and the UUPA. In conducting the research, the authors will use descriptive analytical research methods, namely research that aims to analyze the problems of buying and selling land according to the law, legal theories and practices of positive law implementation concerning issues regarding agreements that have been made based on the Civil Code and the UUPA. From the results of the study it can be concluded that the making of land deeds that are not in accordance with the procedures for making deed is caused by several factors including: (1) the purpose of saving the sale and purchase transactions carried out by the PPAT, (2) the establishment of mutual trust between the parties and the PPAT, (3) the busyness of various parties who will enter into a sale and purchase agreement so that the PPAT adjusts the time to be able to enter into a sale and purchase agreement for both parties, (4) reasons for time efficiency for the parties, (5) the amount of the sale and purchase transaction value to be In this way, PPAT wants to follow the wishes of the parties who will make a sale and purchase agreement, (6) there is a good relationship, and (7) requests from the parties who will make a sale and purchase agreement.
