A CAPTAÇÃO ILÍCITA DE SUFRÁGIO

Abstract

O objetivo deste artigo e discorrer acerca da Captacao Ilicita de Sufragio, analisando aspectos legais, doutrinarios e jurisprudenciais, bem como levantar dados estatisticos no tocante as sancoes aplicadas aos candidatos infratores nos ultimos anos. O Artigo 41-A da Lei 9.504/97,  busca concretizar e afirmar na protecao, ao mesmo tempo, do direito de voto de cada eleitor, individualmente considerado, e a liberdade de escolha de sua opcao por um candidato ou partido politico, sem interferencia de fatores que comprometam a sua consciencia, e o correto exercicio da democracia. ABSTRACT The aim of this paper is to discuss about the Unlawful Capture of Suffrage, analyzing the legal, doctrinal and jurisprudential aspects, as well as raising statistics with regard to penalties applied to the election candidates offenders in recent years.  The Article 41-A of Law 9.504/97 seeks to achieve the protection of the right to vote of each voter, individually considered, and the freedom of choice of opting for a candidate or political party, without interference from factors that compromise their conscience, and the proper exercise of democracy.
